TERMS OF SERVICE, GDPR AND PRIVACY POLICY

The mobile application is part of the project “THE SYSTEM FOR IDENTIFYING A TENNIS BALL HITTING THE TRAINING WALL WITH A COMPUTER ‘GAME’ “. The project is co-financed by the European Regional Development Fund from the Intelligent Development Operational Program 2014-2020.

Use of the system or application, even in guest mode, means acceptance of terms.

If you are under 18, it is preferable to ask your parent or legal guardian to read and allow you to use the ADECO SPORT mobile application.

TERMS OF SERVICE OF THE “ADECO SPORT” MOBILE APPLICATION

1) GENERAL PROVISIONS

1.1 These terms of service (hereinafter: “ToS”) define the terms, conditions, and scope of using the ADECO SPORT mobile application intended for mobile devices with the Android operating system (hereinafter: “Application”) and constitute ToS within the meaning of Art. 8 of the Act of July 18, 2002, on the provision of electronic services.

1.2 The owner and operator of the application, as well as the service provider of the services provided through it, is ADECO Roman Drabek with its registered office in Katowice at ul. Mrozna 25, 40-316 Katowice with the NIP number 6291906983 (hereinafter: “Owner”, “Operator” or “Administrator”).

1.3 Under the below ToS the user of the ADECO SPORT mobile application is a person who uses functionalities offered by the application for private use (hereinafter: “User”). Persons under the age of 18 may use the application with the consent of their parents or legal guardians, we recommend that you follow the Google Play Store regulations and use Google Family tools.

1.4 The services provided under the application include the following:

  • Tennis training, improving accuracy or agility, the application will designate the places to hit on the ADECO tennis wall and other helpful tips.
  • Difficulty levels of the game, from the easiest to the most challenging.
  • Game statistics, scores and options to share the results through social media.
  • The application can be downloaded from the online store: Google Play.
  • Upon downloading and installing the application, you enter the agreement and accept the ToS of the application.
  • Downloading and using the application is free of charge.
  • The operator may introduce additional paid functionalities in the future when making subsequent updates to the application. The paid functionalities of the sensor system or application will be clearly marked – the user will have full knowledge of the fees and premium (paid) functions.
  • The application and all materials and information contained within, as well as the layout of the content presented as part of the application, as well as logos, graphic elements, and trademarks, are subject to the exclusive intellectual property rights of the operator or its third parties and are protected by law.

 2) TECHNICAL REQUIREMENTS AND ACCESS TO THE APPLICATION

2.1 The application is available to anyone, however, there are minimal technical requirements of the mobile device as set out below.

2.2 The user’s mobile device on which the application is to be launched should meet the following technical requirements for the operating system:  Android version 9 (or newer), working Google Play Store.

3) RULES OF USING THE APPLICATION

3.1 Users are obliged to use the application in accordance with the applicable laws, the terms of service, and terms of service of the stores from which the application was downloaded, as well as with the principles of social coexistence, including the general principles of using the Internet and mobile applications.

3.2 Users are obliged in particular to use the application and in a way that does not interfere with its functioning.

4) LIABILITY OF THE OPERATOR

4.1 The operator provides technical support on an ongoing basis, ensuring correct operation of the application and related IT Infrastructure.

4.2 The user uses the application voluntarily, on his/her own responsibility and should ensure the proper functioning of the application to the extent that it is dependent on the user (e.g. proper functioning of the mobile device, use of settings enabling receiving current notifications from the application, etc.). The provider is responsible for the operation of related IT services, sensor system and websites associated with the application.

4.3 The operator is not responsible for limitations or technical problems in ICT systems used by user’s mobile devices, which prevent or limit users from using the application and the services offered through it.

5) TERMINATION OF THE USE OF THE APPLICATION

5.1 Users may stop using the application at any time, in particular, if they do not accept the changes introduced to the ToS, the Privacy Policy or the application update. To stop using the application, you must delete your account in the application profile and remove the application from your mobile device. This is equivalent to deleting all user data.

5.2 If the operator finds that the user is committing an offence or breaking ToS or violating the principles of social coexistence or prejudicial to the justified interest of the operator, in particular their good name, the operator may take all permitted actions, including limiting the user’s ability to use the application and the services provided through it.

5.3 You are not allowed to copy decompile or modify the application, any part of the application or our trademarks, change or modify any logo elements in terms of form, colour or proportion. Any attempts to extract the source code of the application, the system for identifying a tennis ball hitting the training wall with a computer “game” and communication with the interconnected systems are forbidden.

6) COMPLAINTS

6.1 All complaints related to the use of the application and the provision of services through it, as well as questions regarding the use of the application should be directed to the operator at the e-mail address application@adeco-sport.com.pl

6.2 The complaint should include: user’s e-mail address, technical data (name and model of the mobile device, operating system version, Google account), as well as a detailed description and indication of the reason for the complaint.

6.3 Within 14 days from the date of receipt of the complaint, the operator will consider the complaint and inform the user by e-mail about the method of its consideration. In a situation where the data is missing and further information is needed, the operator asks the user to supply it before considering the complaint. The time over which a user provides additional information extends the time needed to consider complaint.

7) SECURITY OF PERSONAL DATA

7.1 The customer has the right to access their personal data, rectify or delete them, transfer personal data, request the restriction of the processing of personal data and object to their processing. Providing personal data is voluntary, but necessary for the full operation of the ADECO SPORT mobile application. The data is processed in accordance with the Regulations of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data.

The data is stored by ADECO Roman Drabek for the period of using the application and having an account in it. The data is not shared with third parties other than those contained in the ToS(and only for the purpose listed) and is not shared without the consent of the user. The data is used to ensure the functionality of the mobile application and the system for identifying a tennis ball hitting the training wall with a computer “game”.  The data may be used for marketing purposes only and directly by ADECO Roman Drabek mainly to approach prospective customers with a relevant offer or to obtain further consents for marketing.

7.2 Contact with ADECO Roman Drabek regarding the processing of personal data by sending an email to the following address: application@adeco-sport.com.pl. Deleting an account in the profile settings irreversibly removes all data from both the application and the Google Firebase system.

7.3 The Guest application mode does not store any personal data permanently.

7.4 Registered accounts are stored using Google Firebase. Registration using a Facebook or a Google service means that the data is processed by the selected partner, whilst the account still exists in the Google Firebase database.

7.5 ADECO Roman Drabek may use the UX Analytics, Crashanalitics and other analytical systems included in Google Firebase. Such data will not be published anywhere and will only be used to improve our application.

8) FINAL PROVISIONS

8.1 Matters not covered by the ToS, are subject to the relevant provisions of a generally applicable law, in particular, the Civil Code and the Act of July 18, 2002 and its subsequent changes, on the provision of electronic services.

8.2 The operator reserves the right to amend the ToS at any time. Of the ToS, Users will be informed of changes in advance via the mobile application. The changes are considered accepted by the user when he continues to use the application after the changes come into force.

3rd party providers and ToS of their services:

The ToS apply from June 10, 2021.

RULES FOR USING “THE SYSTEM FOR IDENTIFYING A TENNIS BALL HITTING THE TRAINING WALL WITH A COMPUTER “GAME”.

Using the system or application, even in the ‘guest’ mode (without registration), is associated with the acceptance of the Terms of Service.

Please read the Terms of Service for using the sports facility on which you plan to use our system.

1. These Terms of Service (hereinafter: “ToS”) define the rules, conditions and scope of using “The system for identifying a tennis ball hitting the training wall with a computer “game” intended for mobile devices with the Android operating system (hereinafter: “sensors”) and constitute ToS within the meaning of art. 8 of the Act of July 18, 2002 on the provision of electronic services.

2. The owner of the system, is the person who bought our sensors. ADECO Roman Drabek is a creator and manufacturer of the sensor system, with its registered office in Katowice at ul. Mrozna 25, 40-316 Katowice with the NIP number 6291906983 (hereinafter:” IT Administrator”).

3. The user is fully responsible for any damage caused by him/her. Sensors collect data about where the user hits the ball on the wall. The system consists of 4 sensors mounted on the tennis wall, the main module, an LED display (for scores and other information), an LED strip signalling the place of impact and a mobile phone application.

4. Let’s take care of our tennis wall, pay attention to other users as well, report any irregularities noticed to the IT Administrator of the facility, and optionally also to ADECO Roman Drabek to the e-mail address: application@adeco-sport.com.pl

5. Users use the ADECO tennis wall at their own risk. ADECO Roman Drabek is not legally responsible for any accidents that may occur.

6. The property and equipment must be not be vandalised. Users are fully financially liable for any damage and destruction of equipment, sensor system or other devices. Parents or legal guardians are responsible for damage should the minor commit an offence.

7. Users of sensors are obliged to strictly comply with these ToS.

8. Using the ADECO tennis wall on which sensors are installed by persons under 18 years of age, the consent of parents or legal guardians.

9. Special care is recommended for people wearing corrective glasses and contact lenses. Using them during the game is at the owner’s risk and responsibility.

10. People with health preconditions or in unstable state should consult doctor first before a use of the facility and sensors.

11.   When using ADECO wall or nearby field you must follow:

  • compliance with safety rules;
  • maintaining cleanliness and order;
  • entering the field only in a suitable footwear.

12. We recommend you follow the basic restrictions when using our system and the sport facility: 

  • do not bring and use equipment that is not designed for this purpose;
  • do not  destroy any devices or equipment ;
  • do not smoke, drink alcohol, or chew gum;
  • do not litter in the surrounding area;
  • animals are not permitted in surrounding of our system.

13. You use the ADECO tennis wall with sensors at your own risk, the owner of the facility is responsible for safety.

14. The user is obliged to use the devices in accordance with their intended purpose.

15. The LED display above the wall shows the information you have entered in the ADECO SPORT mobile application, including your name (or any other data entered and classified as personal data).

17. Adeco Roman Drabek is not responsible for lost data, incorrectly saved tennis training sessions and any damages resulting from improper operation of the equipment.
